An independent privacy-watchdog board, created by federal law and tasked with reviewing national security programs, declared the phone-records collection illegal in January and called for its end.
The hearing scheduled for Tuesday at the Second U.S. Circuit Court of Appeals in New York stems from a lawsuit filed by the American Civil Liberties Union and its New York affiliate.
